Our brain injury lawyers have secured millions of pounds in compensation to help change the lives of  children, teenagers and adults after medical mistakes left them with cerebral palsy, neurological disability, PVS/minimally conscious state and brain damage leading to permanent disability.

Nothing can prepare the parents of a brain damaged child or the family of a brain-injured adult for the physical and emotional and financial hardship that follow a severe brain injury. Our clients have suffered sudden, life-changing and often catastrophic disability. Many are wholly dependent on others for their most basic care, but routine daily tasks can present insurmountable challenges even for those with milder disability.

For 30 years, we have helped rebuild the lives of clients whose brain injury was caused by medical mistakes, or where negligent medical care significantly increased our client’s disability. We are known for our experience, brain injury expertise and track record of successful compensation claims in England and Wales, and internationally. Our clients often receive substantial, interim payments which mean that help is available at an early stage to pay for essential care, therapies and rehabilitation, specialist equipment, suitable accommodation and other urgent needs.

If you want to claim compensation for a brain injury caused by a non-medical accident, eg on the road, at work or in a public facility, our personal injury team can help you – click here.

How much compensation can be claimed after medical negligence causes a brain injury?

The amount of compensation that can be claimed depends on the type and extent of the client’s injury and disability, their needs arising from their disability and their individual circumstances, so no two clients’ claims are ever exactly the same.

Our most severely injured child clients, who have suffered cerebral palsy and severe neurological damage from injury to their brain around the time of birth, may be unable to walk, feed or look after themselves, or communicate with others. They may have impaired vision or hearing, or severe learning disability, and be totally dependent on others for their care. Others have retained intellect and although they are physically disabled, they are able to study, work and live independently as long as they have support. Other brain injured clients may appear independent and healthy but suffer from ‘hidden’ problems, such as memory and concentration, fatigue, sensory impairment or problems with behaviour. The impact of their injury may only emerge over time as they struggle with new situations, returning to school or work, or living independently.

An individual’s compensation should reflect their disability, how it affects them, and the cost of replacing their losses and meeting their needs over the course of their expected lifespan.

Brain injury compensation claims are complex and must be handled by specialist solicitors with the expertise and experience to secure the compensation that will meet the individual client’s lifelong needs.  Our medical negligence lawyers are top-rated specialists in severe brain injury and birth trauma claims. We investigate thoroughly and carefully calculate each of our brain-injured clients’ claims to ensure that our clients receive their full entitlement to compensation.

Depending on the injured person’s circumstances, their claim may include compensation for:

  • pain, suffering and disability;
  • professional case management;
  • costs of care;
  • costs of rehabilitation;
  • therapies, such as:
  • physiotherapy;
  • occupational therapy (OT);
  • speech and language therapy;
  • hydrotherapy;
  • psychological counselling;
  • assistive technology;
  • costs of medical treatment or surgery;
  • increased costs of suitable accommodation or home adaptations;
  • loss of earnings and pension;
  • specialist equipment and aids;
  • adapted vehicles and transport costs;
  • special educational needs (SEN) (if a child);
  • Court of Protection and deputyship;
  • other additional expenses directly arising from the disability

Protecting vulnerable clients and their compensation

We understand that the thought of a vulnerable person receiving and managing a large compensation settlement is daunting, particularly for many of our vulnerable clients’ families. Our clients are usually reassured to discover that there are many ways in which we routinely help protect our clients’ interim payments and final settlements, so that the best use can be made of their compensation to meet their lifelong needs.

Some of these ways include:

  • obtaining court approval for any settlement, to ensure that it is in the client’s best interests;
  • carefully negotiating settlements which best provide for the client’s lifelong needs, such as guaranteed, index linked annual payments (PPO) , so that money is always available for essential care;
  • appointing a Court of Protection deputy to handle the legal requirements and administration involved in a ‘protected party’s’ compensation fund, and to provide quick access to appropriate funds when needed to pay for the client’s care and other needs arising from their disability;
  • advising on personal injury trusts for clients who are not eligible for Court of Protection deputyship but want  the protection of a trust to safeguard their money.

We can also help shield our most vulnerable clients from media reporting or others’ attention when they receive their compensation by securing a court order protecting their anonymity. You can read more on this here.

"Successfully negotiated a full and fair compensation"

Boyes Turner staff were always helpful and quick to respond. Communicating from the other side of the world presented no problems. Boyes Turner secured generous early interim payments that allowed me to continue my (non-funded) medical treatment that otherwise I could never have afforded. My Boyes Turner solicitor successfully negotiated a full and fair compensation and continuation of funding for future medical treatment and associated costs giving me great peace of mind. Thank you so much Annabelle! I would recommend Boyes Turner solicitors. They are professional, courteous and helpful.
