Boyes Turner’s medical negligence lawyers secured a compensation settlement for a mother who suffered a psychological injury during the traumatic birth of her baby daughter.

After an exceptionally long and distressing labour, our client’s baby was born in a poor condition. She needed resuscitation and was admitted to the special care baby unit (SCBU). As a result of negligent delays in the delivery, the baby suffered damage to her brain and has cerebral palsy.

The distressing labour and delayed emergency delivery caused her mother to suffer a psychological injury with PTSD symptoms including nightmares, flashbacks and anxiety attacks. She also suffered an adjustment disorder and depressive symptoms.

We pursued a birth injury cerebral palsy claim for the baby and a claim for the mother’s psychological injury against the hospital. They admitted responsibility and provided interim payments in the ongoing claim for the child’s cerebral palsy.

Liability was not formally admitted for the mother’s claim, but we were able to conclude her claim with a negotiated an out of court compensation settlement.
