Driving on the wrong side of the road abroad - passenger victim gets £42,000

Our client was a front seat passenger travelling in a car whilst on holiday in Belgium. As the car was driven off the ferry the driver inadvertently positioned the car on the left hand side of the road. A van travelling in the opposite direction hit the vehicle head on due to the driver of the car driving on the wrong side of the carriageway.

Our client sustained whiplash injuries and had immediate pain radiating down from her neck and her shoulder and also down her left arm. She was treated at the Accident & Emergency Department at the local hospital in Belgium.

Our client initially dealt with her claim against the driver of the car she was travelling in on her own behalf and an offer in settlement was put forward by the defendant’s insurers of £2,000. She referred the claim to Boyes Turner specialist Personal Injury solicitors and we continued negotiations and obtained detailed medical evidence on the victim’s injuries.

She had ongoing orthopaedic and psychological problems as a result of the accident. She required referral to a spinal injury consultant who considered her ongoing pain issues. Referral was sought to a pain management specialist.

Liability was admitted and proceedings were issued and served . After several months of negotiation the claim was settled without having to proceed to trial for £42,000.
