Family of former oil refinery worker exposed to asbestos receive compensation

Boyes Turner LLP were instructed to make an asbestos disease claim by Mr R, following his diagnosis of asbestosis, an asbestos related disease. 

The facts of Mr R’s case

Mr R was employed to work at the Fawley Oil Refinery as an instrument technician.  The instruments Mr R was working on were high pressure steam pipe meters.  The steam pipes were all lagged in asbestos lagging or wrapped in asbestos rope.  Often Mr R was working in the vicinity of asbestos laggers mixing water and raw asbestos powder together to form the asbestos lagging mix.  It was this asbestos exposure that led to Mr L to suffer from the effects of an asbestos related disease.

Mr R’s investigation of Mr R’s case

Our specialist asbestos claims lawyer took a detailed statement from Mr R and used this evidence in order to pursue a claim against Mr R’s previous employer, Esso Petroleum Company Limited (“the defendant”).

Boyes Turner also assisted Mr R in applying for government benefits which he was entitled to, namely Industrial Injuries Disablement Benefit and a lump sum payment under the Pneumoconiosis (Etc) (Workers Compensation) Act 1979.

Court proceedings

The defendant refused to negotiate a settlement of the claim and denied liability for Mr R’s injuries.  Boyes Turner issued and served Court proceedings and the matter proceeded through the Specialist Asbestos Division of the High Court.

Sadly Mr R passed away shortly after the issue of proceedings. 

Boyes Turner continued fighting for justice for Mr R under the instruction of his widow.

Justice for Mr R

Following the disclosure of various witness statements and other documentary evidence by Boyes Turner the defendant eventually entered in to settlement negotiations with Mr R’s widow.  Mr R’s sstate was compensated for Mr R’s injuries and all out of pocket expenses arising from his injuries.
