Claim settled fafter delay in diagnosis of detached retina results in 70% loss of vision
A 56 year old woman has been awarded £65,000 after instructing our medical negligence claims team in relation to a claim for a delay in diagnosis of a detached retina which lead to a loss of vision that could have been avoided.
The woman woke up one morning, and noticed that her vision had become distorted. She went immediately to the ophthalmic department of the defendant hospital, where she was examined by an ophthalmic nurse.
Failure to examine patient
The nurse telephoned the 'on call' consultant ophthalmologist who advised that it was not necessary for him to examine the woman in person, but that he would call her the next day. The woman was therefore discharged. She attended her optometrist the next day, who immediately diagnosed a retinal detachment and referred her to hospital. The woman subsequently underwent an operation to repair the detachment. She has been left with a loss of approximately 70% vision in one eye.
Medical negligence claim
We instructed an expert ophthalmologist, who confirmed that, had the woman’s detached retina been diagnosed when she first presented to the hospital, her loss of vision would have been almost completely avoided.
A letter of claim was sent to the defendant hospital, who admitted liability in the case. A settlement figure of £65,000 was negotiated and there was no cost to the woman in bringing the claim, which was funded by a No Win No Fee Agreement.
