£200,000 compensation for widow of lagger after mesothelioma death
Boyes Turner's expert asbestos claims lawyers were instructed by Mr C following his diagnosis of mesothelioma. Mr C's widow then took over the claim when Mr C passed away as a result of his mesothelioma.
Mr C was employed by William Kenyon & Sons between 1957 and 1960/61 as an Apprentice Lagger. He worked on a number of different sites including Shell Oil in Trafford Park, Hedley & Co Soap Factory, Chadderton and Agecroft Power stations.
Mr C Would mix asbestos in a big pan which would be approximately 10 foot by 12 foot in size. There would be clouds of asbestos dust all over the place which would cover Mr C from head to toe.
As a consequence of Mr C's exposure to asbestos he developed mesothelioma. Boyes Turner was instructed in December 2010 and began investigating Mr C's claim before his diagnosis of mesothelioma was confirmed in April 2011.
Boyes Turner investigated the circumstances of Mr C's exposure to asbestos and obtained expert medical evidence from an asbestos specialist.
Mr C lived on a large property covering some 14 acres and upon his death the maintenance and upkeep of this property became the responsibility of Mrs C. Mr C was skilled in many areas of DIY and had built stables on their land to house a number of family horses. He was able to maintain the property without assistance from other tradesmen.
Mrs C had to employ a number of tradesmen to undertake the maintenance on her property upon Mr C's death. Mrs C was unable to maintain the property alone as she suffers with severe lumber spondylosis.
Mr C had also provided increasing care to Mrs C as her mobility gradually became more restricted as her own condition deteriorated.
Boyes Turner obtained expert medical evidence on Mrs C condition and expert evidence on the care and assistance and aids and equipment that she would require in the absence of Mr C's care and assistance.
Boyes Turner successfully concluded the claim on behalf of Mrs C for £200,000.
