Boyes Turner’s personal injury solicitors secured a £235,000 compensation settlement for a young woman who suffered multiple injuries when her taxi was hit by a drunk driver’s uninsured car. Our client and her husband were returning home from festive celebrations when their taxi was hit by a drunk driver’s car. The young couple were not wearing seatbelts and our client suffered devastating, impacted facial injuries requiring extensive facial reconstruction and dental reconstruction surgery, as well as hip dislocation with sciatic nerve damage and foot drop, fractured ribs, deep lacerations, pulmonary embolisms, neuropathic (nerve) pain and psychological injury. We provided immediate post-accident support to the injured woman and her family, and liaised with the police and notified the Motor Insurers’ Bureau (MIB) of the claim arising from the road collision and injuries caused by the uninsured driver. Collaboration with MIB leads to fully funded rehabilitation We invited the MIB to work with us to prioritise our client’s rehabilitation and they provided funding which enabled us to get her rehabilitation underway. Our client’s failure to wear a seat belt had contributed to the severity of her facial injuries, and her final compensation would be reduced by an agreed percentage to reflect her contributory negligence. By working collaboratively with the MIB, we were able to ensure that our client’s rehabilitation was fully funded directly by the MIB under the Rehabilitation Code rather than paid out of her compensation. We arranged for our client’s immediate needs to be assessed by a case manager. Following the immediate needs assessment (INA) our client received ongoing case management and intensive multidisciplinary rehabilitation including neuro-physiotherapy, orthotics, occupational therapy (OT), tendon transfer for her footdrop, dental surgery and psychological treatment. In addition, we secured interim payments totalling £15,000, to ease our client’s financial hardship arising from her injuries. The MIB admitted primary liability on behalf of the uninsured driver and, once our client’s injuries had stabilised, made a settlement offer of £235,000, reflecting a 25% discount for contributory negligence.
