Boyes Turner’s personal injury solicitors secured a £180,000 settlement and funded rehabilitation in an MIB claim for a taxi passenger who was injured when his taxi was hit by an uninsured vehicle driven by a drunk driver. Our client and his wife were on the way home from a festive night out when the intoxicated driver’s vehicle collided with their taxi. He was asleep and not wearing a seatbelt when the collision occurred. He suffered musculoskeletal (MSK) injuries to his neck, shoulder, back and knee, facial lacerations and scarring and a concussion head injury, ongoing pain and a psychological injury. Whilst recovering from his own injuries, he provided extensive care to his severely-injured wife and took over the care of their children. He and his wife were unable to return to work, placing a severe financial strain on the family. MIB claim leads to interim payments and funded rehabilitation We notified the Motor Insurer’s Bureau (MIB) of our client’s claim arising from the injuries he was caused by the uninsured driver’s collision with the taxi. MIB admitted primary liability and, over the course of the claim, provided interim payments totalling £34,000 to ease our client’s financial hardship. We worked collaboratively with the MIB’s solicitor and secured rehabilitation funding which paid for a case manager’s immediate needs assessment (INA) and private treatment for our client, including knee surgery (meniscal repair, ACL reconstruction), physiotherapy and psychological treatment. Our medical experts advised that our client’s long-term prognosis following his knee injury means that he will not be able to continue plumbing work from between the age of 40-50. We served expert evidence in support of our client’s claim and pushed for early settlement negotiations, resulting in a £180,000 settlement. The settlement took into account a 25% discount for our client’s contributory negligence in failing to wear a seatbelt, which if worn would have avoided his severe injuries.
