Melloney acted for John* who was unfortunately diagnosed with mesothelioma in 2024, at the age of 83. Exposure John worked as an electrician for many years. His exposure to asbestos occurred during his employment in the mid-1960s, where he was based alongside laggers as they mixed up asbestos powder to apply to pipework in the boiler room where he worked. As part of his job, John also had to crawl through ceiling voids which had pipes lagged with asbestos. Symptoms and diagnosis John sadly suffered from a stroke in December 2023, however he recovered well. Following the stroke, he started to experience shortness of breath and so attended hospital where it was found that he was suffering from a pleural effusion. He was admitted to hospital for a couple of days and had fluid drained from his lungs. In February 2024 he was then diagnosed with mesothelioma. He had a chest drain fitted which helped with his breathlessness. Claim and Diffuse Mesothelioma Payment Scheme The company that John worked for when exposed to asbestos was dissolved many years ago. Companies House does not hold any records of the company and so in an attempt to pursue a successful claim we undertook thorough research into the employers’ liability insurers at the time, which included reaching out to potential insurers to see if they were responsible for the insurance of the company during the years that John was employed. Unfortunately no insurance could be traced. There is a scheme that is used as a last resort, known as the Diffuse Mesothelioma Payment Scheme (DMPS), which compensates those suffering from mesothelioma due to asbestos exposure during the course of their employment, where the employer is no longer in existence and there is no insurance. Melloney decided that this would be the best course of action and so made an application. The DMPS application was successful and the amount awarded to John under the scheme was £112,000 gross. DMPS awards are tariff-based and aim to reflect what an average mesothelioma patient of the same age would receive via a civil claim.
