We were recently instructed by the widow of a gentleman who had sadly passed away from mesothelioma in December 2014. The gentleman had been exposed to asbestos whilst working as a painter and decorator for J Byard & Sons Limited, working at the then Frys Somerdale factory in Keynsham, Bristol.

Exposure to asbestos

The work he did involved removing asbestos ceiling tiles and wire brushing and painting asbestos guttering and cladding by way of preparation, together with working on asbestos lagged pipes.

The work was particularly dusty and resulted in the gentleman being exposed to significant levels of asbestos dust during this period of employment.

The gentleman was only diagnosed a few days before his death, although he had been unwell for several months beforehand. 

The gentleman’s widow was advised to take legal advice shortly after her husband had died and she made contact with us as specialist industrial disease lawyers. 

Making a mesothelioma claim

We set about taking her instructions and contacting a former colleague to take evidence of exposure to asbestos.

Insurers were traced for J Byard & Sons Limited and once the whole case had been presented to them, including supportive medical evidence and details of the losses being claimed, the insurers conceded liability and made an offer to settle the claim, which was readily accepted by the gentleman’s widow.

Settlement was agreed for a six figure sum and the widow was delighted with the outcome and the diligence and hard work put in by us.
