Mr W’s asbestos exposure history

Mr W was employed as a labourer working for Imperial Chemical Industries Limited, more commonly known as ICI, between 1956 and 1959.

Mr W’s working role involved him mixing asbestos lagging up from raw asbestos powder and water in a trough by hand and then applying it to pipes and boilers.

Boyes Turner’s investigation of the claim

Boyes Turner sent a full letter of claim to ICI asking for an immediate decision on liability, though none was provided.

Boyes Turner then obtained a full medical report confirming that the disease was suffered following exposure to asbestos and made an offer to settle the claim. The offer was not accepted.

As the defendant was unwilling to settle Mr W’s claim Boyes Turner issued proceedings in the Royal Courts of Justice, London in attempt to gain justice for Mr W.

A full defence was filed by the defendant denying liability and the matter was listed for a specialist Court hearing. One day before the hearing the defendant made an offer to settle the claim and the Court hearing was vacated.
