Boyes Turner’s asbestos claims team recently dealt with a fatal mesothelioma claim brought by the executor of the estate of Mr X. Previous solicitors had abandoned the claim during Mr X’s lifetime.

His exposure took place whilst he worked as a carpenter with C.S. Wiggins and Sons Limited between 1964 and 1979 regularly using asbestos board and asbestos corrugated roof sheets.

Asbestos exposure was also alleged against Southend Hospital in respect of employment undertaken by Mr X in the maintenance department from 1980 until his retirement in 2009. As a result of his exposure to asbestos, Mr X was diagnosed with mesothelioma, from which he died in 2012 at the age of 64.

The executor’s claim included a financial dependency claim for his two young children.

The claim was concluded successfully and the Court readily approved the settlement reached for one of the dependant children, who remained under the age of 18 at the time of settlement.
