Boyes Turner’s personal injury claims lawyers secured a £150,000 settlement for a man who was hit by a car which was driven through a shopfront window. Our client was inside the store, sitting by the window, when the car crashed through the display window and hit him. Our client suffered multiple fractures to his leg and urological injuries. He needed surgery and external fixation of the leg. The fractures healed but he was left with stiffness and deformity in the ankle. As a result of the deformity, he needs an orthosis and modular footwear, and ongoing physiotherapy. He has limited mobility and has developed osteo-arthritis of the ankle. He will probably need ankle fusion surgery in future. During our client’s stay in hospital he suffered acute urinary retention and needed catheterisation. He underwent urological surgery and endoscopic resection of the prostate and was left with erectile dysfunction. He suffered psychological injuries, including severe post-traumatic stress disorder (PTSD), an adjustment disorder and depression. We secured a £20,000 interim payment from the car driver’s insurers to meet our client’s immediate needs whilst the claim continued. Our client was one of many people who were injured by the driver’s negligence, but the police initially failed to prosecute the driver, only finally doing so in response to a public outcry. Despite overwhelming evidence that the driver had negligently caused our client’s injuries, the driver’s insurers delayed admitting liability (fault) until after the criminal court proceedings. Following the admission of liability, the insurers made an offer to settle our client’s claim for £75,000. On our advice, he rejected the offer. After negotiations, we secured an increased settlement offer of £150,000, which our client accepted.
