Boyes Turner’s motorcyclist injury solicitors secured an early settlement of £125,000 plus rehabilitation funding for a motorcyclist who suffered severe injuries to his right leg when he was hit by a car emerging from a side road.

Motorcyclist suffers severe leg injuries when hit by car emerging from a side road

Our client was riding his motorcycle along a dual carriageway when he was hit by the defendant driver’s car as it emerged from a junction to cross the major road. The car hit our client on his right side, causing him to be thrown from his bike and into the road.

He was taken by ambulance to hospital, where he was found to have suffered open right tibia and fibula fractures and an open wound to his right lower leg. His fractures needed external fixation and additional further surgery. He was deeply traumatised by the accident and suffered a psychological injury.

As a self-employed Deliveroo and Uber driver, our client’s income was affected whilst his leg injuries prevented him from being able to work. His injury also impaired his ability to move freely around his home, where his room was on the second floor.

Car driver’s insurers dispute liability for collision and motorcyclist’s injuries

Our client instructed us to help him make a claim for compensation against the driver whose negligence had caused the road collision and his injuries.

We served an early notification letter on the driver’s insurers, who disputed liability on behalf of their driver.

We instructed a road collision investigation expert to examine and report on the relevant evidence relating to the collision, including CCTV footage. We also obtained a supportive statement from someone who had witnessed the collision.

Funded rehabilitation for injured biker during and after the claim

Meanwhile, we secured the insurance company’s cooperation in working with us to prioritise our client’s recovery and rehabilitation. We (jointly) instructed a case manager to assess our client’s immediate needs, and secured funding from the insurers under the Rehabilitation Code which enabled our client’s physical and psychological rehabilitation to begin.

We also arranged for our client to receive expert advice on his eligibility for welfare benefits, to ease his financial hardship.

Early, out-of-court settlement provides £125,000 lump sum plus ongoing funded rehabilitation

Whilst both parties awaited expert orthopaedic medical evidence, the driver’s insurers made a verbal offer to settle the claim for £75,000. We advised our client to reject this offer, along with their subsequent, written, time-limited settlement offer of £100,000.

The defendant then made a Part 36 settlement offer of £125,000. Our client instructed us to respond with a counter-offer of settlement which would provide a lump sum of £125,000 plus the additional costs of his ongoing rehabilitation. The additional rehabilitation costs exceeded £18,800 and enabled our client to continue receiving case management, MSK physiotherapy, hydrotherapy, scar management and psychological treatment.

Our client’s settlement offer was accepted, resulting in settlement within just over six months of the accident, without the need for court proceedings.
