Successful Product Liability claim - Trampoline
A six year old girl was playing on a new trampoline in the back garden at her home. She got down from the trampoline using the ladder on the trampoline (supplied by the sellers). As she stepped onto the ladder she slipped and fell to the ground injuring her left elbow.
We established that this size of trampoline (8ft) is not usually supplied or recommended for use with a ladder, which if used would be at a dangerous angle. This is what caused the girl to slip. We made a product liability claim against the people who sold the trampoline package to the girl’s parents - on the basis that it was not fit for the purpose for which is was supplied. We argued that this meant they had breached the Consumer Protection Act and the Sale of Goods Act.
Following a letter of claim sent to the defendants, liability was admitted within three months.
The personal injury claim settled for £7,500.
