Pillion passenger receives £110,000 after road traffic accident

Boyes Turner Personal Injury lawyers recovered £110,000 compensation for a female motorbike pillion passenger.

There were two defendants in this case – the car driver who changed lanes too quickly in heavy motorway traffic, and the motorcyclist who was driving to close to the vehicle in front to allow him to take evasive action. The motorbike clipped the car, the front wheel “flipped” and the motorbike came to rest on the central reservation on the M4 near Wootton Bassett in Wiltshire. The motorcyclist suffered only minor bruising but our client, his pillion passenger, suffered a fractured right elbow along with soft tissue injuries to her neck lower back, right hip and both knees.

The claimant, from Headington in Oxford,  made a good recovery from her soft tissue injuries with some residual aching in her right hip, lower back and right knee. Her most significant injury was to her elbow. She underwent three surgical procedures and although she was only 24 at the time of the accident she has been left at risk of developing osteoarthritis in her elbow as a result.

At the time of the accident the claimant was working as a senior domestic assistant in a hospital. She had plans to study and to qualify as a paramedic. As a result of her injuries however she was left unable to cope with more than very light manual work and was forced to resign her position. The claimant recovered future loss of earnings on the basis that she is now unlikely to be able to do manual work, together with an element for the loss of her chance to retrain as a paramedic.

Proceedings were issued but the claim settled by way of negotiation in the sum of £110,000.
