Motorcyclist receives £18,000 compensation after RTA claim
The claimant was a 35 year old motor cyclist. He was travelling home from work on his BMW motorcycle one evening in August when he was struck by a car as it left a roundabout and veered towards the centre of the road and into the path of the motorcycle. The claimant was thrown from his motorcycle and landed several feet away becoming separated from his motorbike in the collision.
He sustained serious injuries in the motorbike accident including a severe comminuted fracture of the right proximal tibia extending into the knee joint articular surface. He required emergency fasciotomy surgery and was admitted to hospital. He was left with permanent pain in his right leg and significant scarring. He also developed multiple fat lesions in his leg.
He suffered loss of earnings and remained handicapped on the open labour market.
A claim was issued against the negligent driver of the vehicle which hit him and which caused the motorbike crash. The position of the motorbike and the motorbike rider after the motorcycle accident became a key evidential issue in the liability case.
The police officers’ notebook indicated that the claimant had been on the wrong side of the road when the accident occurred. The claimant denied this and we obtained detailed logs from the Ambulance Service and the claimant’s mobile phone company which showed the time of arrival of the emergency services to the scene and the actions they took in moving and relocating debris. This became important evidence of the unreliable nature of the police notebook in assessing the final resting place of the debris of the accident, immediately after the motorcycle crash.
Independent witness evidence was pursued from bystanders at the scene of the accident. Eventually the defendant accepted an offer of compensation made on behalf of the claimant and this was agreed in full and final settlement for his claim for his motorcycle injuries.
