Successful diffuse mesothelioma payment scheme application for partner of driver with mesothelioma

Boyes Turner were instructed in November 2015 by a gentleman who had been diagnosed with mesothelioma in September 2015.

He had been exposed to asbestos whilst working for James & Co, agricultural millers, as a driver.

His evidence was taken and the company was investigated but unfortunately insurers for the period of his employment could not be traced.

Sadly, the gentleman died in January 2016 and I remained instructed by his partner.

Diffuse Mesothelioma Payment Scheme (DMPS)

Given that insurers could not be traced, an application was made to the Diffuse Mesothelioma Payment Scheme (DMPS).  The application was made in April 2016 and the Scheme Administrators dealt with the application promptly, confirming in May 2016 that a payment would be made.

A six figure sum was paid by the Scheme and the family of the deceased gentleman are delighted with the outcome.

The Diffuse Mesothelioma Payment Scheme was set up to compensate people with mesothelioma who were exposed to asbestos either negligently or in breach of statutory duty by their employers but who are unable to bring a claim for compensation against that employer or the relevant employers’ liability insurance. The Scheme can also consider making payments to eligible dependants of a mesothelioma sufferer who has since passed away.
