Our asbestos claims team were instructed by Mr H, following his diagnosis of pleural thickening, an asbestos related disease.

Mr H was employed to collect and deliver various materials from different building suppliers as a contractor. One of the places Mr H collected from was Cape Building Products Limited (“Cape”), a supplier of asbestos materials. Mr H’s working role involved him assisting in the loading of various asbestos sheets on to his flat bed delivery lorry whilst at Cape’s premises. In carrying out his working role Mr H was exposed to copious amounts of asbestos dust.  It was this asbestos exposure that led to Mr H to suffer from the effects of an asbestos related disease.

Peter Olszewski, a specialist asbestos disease solicitor, took a detailed statement from Mr H and used this evidence in order to pursue a claim against Mr H’s previous employers. He also assisted Mr H in applying for government benefits which he was entitled to, namely Industrial Injuries Disablement Benefit and a lump sum payment under the Pneumoconiosis (Etc) (Workers Compensation) Act 1979.

Initially the defendant refused to negotiate a settlement of the claim and denied liability due to the fact that Mr H was not a direct employee of Cape. Due to the complexities of Mr H’s employment history we issued and served Court proceedings and the matter proceeded through the Specialist Asbestos Division of the High Court.

Following the disclosure of various witness statements and other documentary evidence Cape eventually entered in to a settlement with Mr H, following the service of proceedings.
