Claim settled for £10,000 following back injury sustained in accident at work

Boyes Turner specialist personal injury team have been recently representing a client in respect of injuries sustained as a result of an accident at work.

Our client was employed as a Track Man and his work involved the removal of rail sleepers from a rail track. On the day of his accident our client had been requested by his supervisor to remove one sleeper with two other colleagues. This should have been carried out by a team of five men. As he attempted to pull the sleeper he felt a sharp pain in his back.  

The defendant's insurers admitted liability from the outset but causation was denied. 

As a result of the accident our client has sustained a strain to his lumbar spine. He required physiotherapy treatment and steroid injections. He had previously suffered an injury at work approximately a month before the accident in question which made valuation of his claim more complex. However he had made a good recovery from this incident by the time the accident in question occurred and medical evidence obtained showed that if his accident had not occurred, he would have recovered from the earlier incident within several months without having to take further time off work.

The matter settled out of court in the sum of £10,000 after commencement of court proceedings.
