Successful DMPS Application within 3 months of mesothelioma diagnosis
John was diagnosed with mesothelioma in February 2019 after suffering from shortness of breath over some months, initially thought to be due to a chest infection. Eventually, he was admitted to hospital and investigations revealed his devastating diagnosis of mesothelioma.
John instructed us quickly after his diagnosis to investigate his potential claim.
After leaving school John worked as a bathroom tiler before becoming a bricklayer.
John’s asbestos exposure came about whilst working for T Jones (Harrow) Ltd who were builders based in Wealdstone. He worked for them on a job at Harrow on the Hill School, including the refurbishment of the boiler house. He had to build brick bases for the new boilers to stand on but other tradesmen had already removed the old boilers and necessary pipework beforehand which involved the disturbance and removal of asbestos lagging, leaving asbestos dust and debris behind. John came into contact with that asbestos dust and debris.
At the same school he also relined a chimney. This was enclosed working with no ventilation using asbestos fire bricks, which were lighter than ordinary bricks. The fire bricks were dipped into a “fire clay” which was a jointing compound containing asbestos.
John’s working environment was dusty from the powder having been tipped out of bags and mixed in bins in very close to proximity to where he was working.
John later became self-employed. His only known asbestos exposure was during his employment with T Jones (Harrow) Ltd.
Diffuse Mesothelioma Payment Scheme
We investigated whether a claim could be brought against T Jones (Harrow) Ltd but the company was out of business and unfortunately there was no trace of insurers for the period of John’s employment.
The claim therefore had to proceed as a Diffuse Mesothelioma Payment Scheme (“DMPS”) application.
The Diffuse Mesothelioma Payment Scheme (DMPS) was enacted in 2014 to allow mesothelioma victims to claim a lump sum payment from the Government where the negligent former employer is no longer trading and its insurers cannot be traced.
We submitted the DMPS application swiftly and after just one month we were notified that John’s application had been successful and he was to receive a six-figure sum by way of compensation.
Within three months of first instructing us, John had received his compensation and the claim was concluded.
