£200,000 compensation recovered for family of baby with Erb's palsy
Boyes Turner's expert solicitors recovered compensation for the parents of a baby who has Erb's palsy after suffering a severe right brachial plexus palsy and dislocation of his right shoulder at the time of his delivery at an NHS hospital in 1990.
Baby M underwent several surgical procedures but has Erb's palsy with the function of his right arm being severely impaired. In addition to the problems with his right arm Baby M has significant learning/behavioural problems and has undergone surgery for epilepsy. However this was not related to the negligent management.
Medical negligence claim
Extensive medical notes and records were obtained from the defendant hospital, the GP and the treating hospitals. The letter of claim was served and a letter of response was received which admitted liability for M's Erb's palsy.
The defendant made a Part 36 offer of £80,000. Following conference with counsel and further negotiations, settlement was agreed at £200,000.
