£150,000 claim settled for widow of painter & decorator with mesothelioma
Our asbestos claims lawyers were instructed on behalf of Mr R in respect of a claim for compensation arising from his diagnosis of mesothelioma. Mr R had previously instructed another firm of solicitors who had closed their file of papers after investigating a claim in relation to his employment with St Alban's Gasworks.
The previous solicitors did not pursue the claim any further as his exposure was deemed not to be heavy enough for the levels of exposure required pre-1965 to pursue a claim. Mr R had also been exposed to asbestos whilst working as a painter and decorator for J Hammond & Son Limited. This is now a dissolved company and employer’s liability insurers could not be traced.
Mr R then instructed us. When we investigated matters further, and went through Mr R’s employment history with him in detail. It became apparent that he had also been employed by John Zink Company Limited but he was not able to recall this employment in any great detail. He worked at a factory in Acrewood Way in St Albans where the company carried out steel fabrication work in order to manufacture various vessels, engines and burners. We therefore spoke to his two brothers who also worked there and took statements from them. In addition, we placed a witness appeal in the local newspaper, from which we obtained a further five witness statements in support.
Mr R sadly passed away during the claim and it was taken over by Mrs R.
Court proceedings were issued and we have now successfully settled Mrs R’s claim in the sum of £150,000.
