Whether a patient receives treatment in an NHS or private hospital, they are entitled to expect a safe and acceptable standard of care.

What is hospital negligence?

Mistakes which happen during care in or under a hospital's authority and which are considered mistakes that no reasonably competent medical practitioner in the relevant discipline would make are hospital negligence. Failures of equipment and systems can also result in successful compensation claims. To succeed in a hospital negligence claim, it is necessary to both show that negligent mistakes were made and also that, as a consequence of the negligent mistakes, the patient has suffered injury.

NHS vs private hospital

If a claim arises because a member of NHS staff in a hospital has caused injury to a patient by providing negligent treatment, NHS Resolution will defend or settle the legal claim.

If a patient has experienced hospital negligence in a private hospital, the medical professional who provides the negligent care is generally self-employed and is personally responsible for the consequences. They will usually be represented by their own defence organisation, which will pay the compensation. The private hospital may, however, be liable for any harm caused by their employees, facility, or equipment.
