Boyes Turner’s road traffic accident (RTA) claims team have secured a £1.15 million settlement for a pedestrian who was injured when hit by an Uber vehicle. The driver admitted liability for our client’s injuries.

Our client suffered comminuted fractures (in which the bones are crushed or splintered into pieces) of the left tibia and fibula (long bones of the leg). Surgical procedures were needed to fix the fractured bones internally, and later to remove the metalwork. Our client regained most of the movement and function in the knee and ankle, but was left with knee pain, sensitivity and scarring, and a psychological injury.

We pursued our client’s claim for compensation, which included a substantial claim for our client’s loss of earnings, bonuses and benefits as a commodities trader. Following the accident our client was unable to work during a prolonged period of recovery. Our client was unable to travel internationally, had to hand over clients to other colleagues and missed out on vital training necessary to adapt to the changing market and trading practices. Our client was asked to take voluntary redundancy and initially struggled to find similarly paid, suitable employment.  

We held a joint settlement meeting with the driver’s insurers and legal representatives, but negotiations failed when the driver’s insurers significantly undervalued our client’s claim. We pursued the claim and prepared the case for trial. During preparations for trial, the defendant substantially increased their offer to settle the claim at £1,150,000, which our client accepted.
