Boyes Turner’s cerebral palsy specialists secured a £2,225,000 compensation settlement for a boy whose cerebral palsy was caused by damage to his brain during a twin-to-twin transfusion in the weeks before his birth. At around 24 weeks of the monochorionic twin pregnancy, a consultant obstetrician noted signs of twin-to-twin transfusion syndrome (TTTS) on the antenatal scans but negligently delayed referral for fetal laser ablation treatment until 26 weeks gestation, which was incorrect for monochorionic twins. By the time the referral was made it was too late for treatment to avoid further damage to the unborn twins who were already suffering from severe TTTS. They were eventually delivered, premature, by caesarean section. Our client had suffered severe cystic periventricular leukomalacia which the experts believed was probably caused by lack of oxygen and reduced blood supply to the brain as a result of TTTS. Whilst the defendant hospital accepted that the consultant had managed the TTTS incorrectly, they strongly denied responsibility for our client’s disability supported by experts’ evidence suggesting that earlier treatment would not have prevented our client’s brain injury. We overcame their defensive stance and protected our client’s ability to receive substantial compensation to help meet his extensive needs by negotiating a liability settlement which secured him 50% of the full value of his claim.
