Boyes Turner’s personal injury lawyers have secured a compensation settlement of £400,000 plus ongoing funded rehabilitation for a client who suffered multiple injuries and complex musculoskeletal injuries when he was hit by a speeding vehicle.

Our client’s injuries included fractures to his shoulder and ribs, injury to the head, tinnitus and reduced hearing and multiple soft tissue injuries. He was left with a whiplash injury and pain in his hip, low back and neck. The accident caused an exacerbation of a ten-year-old PTSD condition which had previously resolved.  His psychological injury led to symptoms including disturbed sleep, loss of confidence, flashbacks and nightmares, avoidance behaviour, anxiety and agoraphobia.

Funded rehabilitation under the Rehabilitation Code

We invited the defendant’s insurer to provide Rehabilitation Code funding urgently to give our client the best chance of recovery by access to early, coordinated rehabilitation. With the insurer’s cooperation and funding, we jointly instructed a case manager to assess our client’s immediate needs, enabling us to arrange for him to have coordinated multi-disciplinary treatment. Our client underwent an urgent psychological assessment and treatment of his PTSD, physiotherapy to manage his pain and restore his mobility, urgent referral to a shoulder specialist followed by an MRI scan and treatment, and various assessments including ENT. 

Our client’s injuries left him unable to return to work driving HGV lorries and have limited his employment options. We arranged for him to have vocational rehabilitation which, following successful psychological and physical treatment, will give him the best chance of getting back into suitable employment.

Interim payments to ease financial hardship until settlement reached

The defendant insurers admitted responsibility for our client’s injuries. We issued proceedings and secured interim (advance) payments totalling £40,000 to help ease our client’s financial worries and meet his immediate needs whilst he underwent treatment. The case concluded with an out of court settlement which provides our client with £400,000 compensation plus guaranteed additional funding of over £6500 for further rehabilitation.
