Boyes Turner’s brain injury team secured a £1 million settlement for a boy who suffered a cardiac arrest, brain damage and spastic tetraplegia with cognitive impairment, as a result of an untreated asthma attack.

The defendant hospital were aware of our client’s condition following his four previous admissions to hospital with acute asthma, but failed to properly monitor and treat his condition. We pursued a claim for our client on the basis that if they had correctly monitored and treated his condition his cardiac arrest and resulting brain injury would have been avoided.

The defendant hospital strongly denied liability for our client’s injury and we took the case to trial. On the first day of trial the case settled for just under £1 million.

The settlement reflected the difficulties in this strongly defended case and the high risk to our client that the case might not succeed at trial. Our client’s life expectation was severely reduced as a result of his injury, further reducing the value of his claim. The settlement provides help for his family in meeting his needs for life-long care.
