Our bespoke Court of Protection expert witness services analyse and forecast future deputyship needs for protected clients, ensuring optimal outcomes.

Our expert witnesses act for litigation solicitors in providing expert evidence in the form of a witness statement or report for the Court in litigation proceedings, with the aim of ensuring that the funds awarded are suitable to meet their ongoing needs.

Expert witnesses can also advise on evidence submitted by the other party. 

Our expert witness service

Alexander Wright leads the team’s Expert Report service line and acts as an expert on past and future deputyship and trustee costs in litigating cases, primarily instructed by other law firms.

Alexander’s experience enabled him to play a leading role in the landmark costs case of PLK & Ors [2020] EWHC B28 (Costs), as deputy for PLK. Alexander was also Chairman of the Professional Deputies Forum in 2023 and was a leading figure in its work when he joined the board in 2019.

What areas can an expert witness statement cover?

Through our expert witness service, our specialist Court of Protection team are available to provide detailed statements on the following aspects:

  • the capacity of the protected individual;
  • whether it is appropriate to appoint a professional deputy;
  • the role of the deputy, and level of input required;
  • future deputyship costs;
  • the issue of proportionality of costs;
  • whether it is appropriate to put a Statutory Will in place.

We can provide statements for both claimants and defendants.

How much does an expert witness service cost?

Our guide on the fees for expert witness services:

  • Preparation of first draft Statement/Report on past and future costs = £3,300
  • Comparison report on counterpart’s evidence = £1,800
  • Preparation of Joint Witness Statement = £2,400

Statements/reports covering trust costs quoted for separately and all fees are excluding VAT.

Correspondence, conferences and revisions of drafts are all charged on a time spent basis, the hourly rate is £300 plus VAT. Please contact the team for an accurate fee proposal tailored to your needs.

How long does an expert witness statement take?

Once instructed, we will confirm your deadlines and work towards meeting them. On average, we aim to deliver the work within two weeks from the date of instruction and receipt of all required documentation.
