Boyes Turner’s personal injury solicitors secured a £257,000 compensation settlement plus more than £20,000 of funded rehabilitation for a 78-year-old woman who suffered multiple injuries when she was hit by a car on a pedestrian crossing at a supermarket car park.

Our client suffered a severe, degloving injury to her foot and ankle, and multiple fractures. She needed multiple surgical procedures, including external fixation and skin grafting. Her injuries impaired her mobility and independence and prevented her from providing care to her husband.

We notified the defendant driver and her insurers of our client’s claim. The driver denied responsibility for the accident, blaming a mechanical fault for her loss of control of her car, however, on inspection, neither the car’s manufacturers nor the police found any fault with the car. 

We secured early Rehabilitation Code funding from the defendant’s insurers. This enabled us to appoint a case manager to carry out an immediate needs assessment (INA) and to arrange for our client to receive physiotherapy, psychological support, and daily visits from a rehabilitation assistant who helped her with her exercises, mobility and daily tasks such as shopping and getting out and about. Early funding also paid for specialist equipment and minor home adaptations to improve her mobility, accessibility and independence at home. Our client has multiple medical comorbidities and suffers from agoraphobia, which made it more challenging for her to accept professional care or inpatient intensive rehabilitation, so as much of her rehabilitation and support as possible was provided for her at home.

Whilst we awaited the necessary medical evidence to enable us to issue proceedings, the defendant’s insurers made an offer of £175,000 to settle the claim. Given our client’s and her husband’s advanced age, her priority was to achieve an early conclusion to the claim. On our advice, she instructed us to enter into further negotiations with the insurers, which resulted in an agreed £275,800 settlement. Our client’s compensation includes provision for further home adaptations, future therapies, orthotics and professional care if needed, as well as help from a gardener and cleaner at home.

Our client’s claim was settled without the need for court proceedings.
