Successful noise induced hearing loss claim for former welder/machine operator
Boyes Turner’s specialist industrial disease lawyers were instructed in March 2008 by a man who had been diagnosed with noise induced hearing loss alleged to have been caused by his exposure to noise during his employment with Barkers Engineering Limited and JCB.
It was alleged that he was exposed to injurious levels of noise for many years.
The man first started to experience hearing difficulties, including tinnitus, in 2007. Boyes Turner instructed a medical expert who concluded that the man’s work related hearing disability was 9%.
Prior to the issue of court proceedings, JCB admitted breach of duty but it was only following service of the issued court proceedings that Barkers Engineering Limited accepted liability as well.
Following negotiations, the claim was settled against both Defendants at a satisfactory level at no cost to our client.
