£75k compensation for occupational asthma victim
Boyes Turner's specialist industrial disease lawyers secured £75k in compensation for a man who's occupational asthma was caused by exposure to chemicals at work.
As a result of his chemical exposure he developed shortness of breath, frequent chest infections and eventually had to move to alternative employment. He was diagnosed with asthma following a health check at work. Over the following months he undertook a number of peak flow measurements which showed that his breathing deteriorated over the working week, and improved at weekends and particularly in the holidays. This meant there was probably a link between his work and the extent of his breathing difficulties.
Medical experts confirmed this and felt that some of the chemicals the man had been exposed to at work would have been capable of triggering his asthma. The defendant's expert disagreed, although he felt that the chemicals could have made the symptoms worse.
At a round table settlement meeting a £75k settlement figure was agreed in compensation for the development of his illness, not merely an exacerbation of his symptoms.
