£123.5k compensation awarded to widow of a carpenter who died from mesothelioma
Boyes Turner's mesotheliom lawyers were instructed by a man following his diagnosis of mesothelioma. A lifetime statement was taken from him which revealed that he was a carpenter by trade and during his working life had worked for a large number of employers for brief periods of time. Sadly, he passed away and the claim was taken over by his wife.
Boyes Turner's mesothelioma lawyers undertook research to try and trace the potential defendants, although the majority of these companies were dissolved and had not taken out employers liability insurance.
One of the jobs that he had undertaken whilst working for a small carpentry firm was at Costain Group Plc. A witness was traced who was able to give evidence that the carpentry firm provided labour only. Costain Group Plc provided the materials and larger tools and equipment and gave the direction. The man had been exposed to asbestos whilst carrying out work for this company.
Court proceedings were issued against Costain Group Plc and judgment was entered, with an order for an interim payment in the sum of £50k.
The man's wife claim has now settled for £123.5k gross.
