Fatal asbestosis claim for widow of British Cellophane worker

Boyes Turner’s specialist asbestosis lawyers were instructed in October 2007 by a man suffering from asbestosis. He had been employed by British Cellophane in Somerset as a plumber’s mate for nearly 20 years and had been exposed to asbestos as a result of this employment. 

Sadly, the man died on Christmas Day 2007 but we had been able to record evidence from him during his lifetime about his exposure to asbestos, which was invaluable to the claim. 

We obtained supportive medical evidence and although liability was accepted by the Defendant, no offers were made to settle the claim. It was therefore necessary to issue court proceedings in October 2008 to progress matters.

A matter of days before the May 2009 court hearing at which a Judge would have decided the compensation that the man’s widow should have received, a satisfactory offer of compensation was made to settle the claim by British Cellophane’s solicitors, which offer was accepted.
